Terms and Conditions
Welcome to ASCERA11. These Terms and Conditions govern your use of the ASCERA11 website and your purchase or use of products, digital products, services, bookings and other offerings made available through the website.
ASCERA11 is operated by Sishi Group Holdings (PTY) Ltd T/A ASCERA11, a South African company.
By accessing or using this website, or placing an order through it, you agree to these Terms and Conditions, together with any additional terms that apply to a specific product, service, booking or event.
1. General Terms
These Terms and Conditions apply to visitors, users and customers of the ASCERA11 website.
You must provide accurate and complete information when placing an order or creating an account and must use the website lawfully.
Where a customer is under the age of 18, purchases should be made with the involvement and consent of a parent or legal guardian.
Nothing in these Terms and Conditions is intended to exclude or limit any consumer right or protection that cannot lawfully be excluded or limited under South African law.
2. Products and Services
ASCERA11 makes reasonable efforts to ensure that product descriptions, photographs, specifications, pricing and other information displayed on the website are accurate and up to date.
Product images are provided for illustrative purposes and colours, textures, finishes and other visual characteristics may vary between a product image and the physical product, particularly where products are handmade, naturally variable or produced in limited editions.
ASCERA11 reserves the right to correct genuine errors or inaccuracies and to update product or service information where necessary.
Where a product or service has specific terms, specifications, limitations or requirements, these will be communicated on the relevant product or service page.
3. Pricing and Payment
All prices displayed on the website will be stated in South African Rand (ZAR), unless otherwise indicated.
The applicable price, delivery charges and other applicable costs will be displayed before an order is completed.
Payment must be successfully received through an accepted payment method before an order is processed, unless otherwise agreed in writing.
ASCERA11 reserves the right to correct genuine pricing or listing errors. If an order has been placed using an incorrect price caused by an obvious error, ASCERA11 will contact the customer before proceeding with the order and, where appropriate, provide the option to cancel and receive a refund.
4. Orders and Order Acceptance
Submitting an order constitutes an offer to purchase the relevant product or service.
An automated order confirmation acknowledges receipt of the order but does not necessarily constitute final acceptance of the order.
ASCERA11 may decline or cancel an order where, for example:
the product is unavailable;
there is a genuine pricing or listing error;
the order cannot reasonably be fulfilled;
a payment cannot be successfully processed; or
there are reasonable grounds to suspect fraudulent or unlawful activity.
Where ASCERA11 cancels an order after payment has been received, the amount paid for the cancelled order will be refunded, subject to applicable law.
ASCERA11 will not use this provision to avoid any consumer rights that apply to an accepted transaction.
5. Delivery and Fulfilment
Delivery times and fulfilment periods will be communicated on the relevant product or service page or during the checkout process where applicable.
Delivery dates may vary depending on product availability, production requirements, delivery location and circumstances outside ASCERA11's reasonable control.
Customers are responsible for providing accurate delivery and contact information.
Any specific delivery terms applicable to a particular product will take precedence over general delivery information.
6. Returns, Refunds and Cancellations
Returns, refunds and cancellations are governed by ASCERA11's applicable policies, including the Physical Products, Digital Products, Bookings and Services, and Event Tickets policies published on this website.
Nothing in these Terms and Conditions limits any statutory consumer rights that apply to a transaction.
Where a statutory right to a refund, cancellation, repair, replacement or other remedy applies, ASCERA11 will comply with that right.
7. Intellectual Property
All intellectual property appearing on or forming part of the ASCERA11 website, including but not limited to logos, names, trademarks, artwork, photographs, graphics, written content, layouts, designs, digital products and other creative material, belongs to ASCERA11, Sishi Group Holdings (PTY) Ltd, or the relevant third-party rights holder, unless otherwise stated.
You may not reproduce, modify, distribute, commercially exploit, sell, license or otherwise use ASCERA11's intellectual property without prior written permission, except where permitted by law.
Purchasing a product, digital product or service does not automatically transfer ownership of ASCERA11's intellectual property to the customer.
For creative services, intellectual property ownership and usage rights may be governed by separate project-specific terms or agreements.
8. Website Use
You may use the ASCERA11 website for lawful purposes and in accordance with these Terms and Conditions.
You must not:
use the website for unlawful or fraudulent purposes;
interfere with the operation or security of the website;
attempt to gain unauthorised access to systems or accounts;
reproduce or exploit website content without permission; or
use the website in a manner that could damage ASCERA11 or its customers.
ASCERA11 may restrict or suspend access to the website where reasonably necessary to protect the website, its users or its business.
9. Third-Party Services and Links
ASCERA11 may use third-party payment providers, delivery providers, technology platforms and other service providers to operate the website and fulfil orders.
The ASCERA11 website may also contain links to third-party websites or services. ASCERA11 is not responsible for the content, availability, policies or practices of third-party websites that it does not control.
10. Limitation of Liability
To the maximum extent permitted by applicable law, ASCERA11 will not be liable for indirect, incidental or consequential loss arising from the use of the website or services.
However, nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by law, including liability arising from rights or remedies that cannot lawfully be excluded or limited under applicable consumer protection legislation.
ASCERA11 does not exclude its responsibility for supplying products or services in accordance with applicable law.
11. Changes to These Terms
ASCERA11 may update these Terms and Conditions from time to time to reflect changes to the business, website, products, services or applicable legal requirements.
The latest version will be published on the website.
Changes will generally apply prospectively and will not retrospectively remove rights that a customer has already acquired under applicable law or an existing transaction.
12. Privacy
Personal information submitted through the ASCERA11 website will be handled in accordance with ASCERA11's Privacy Policy and applicable South African data-protection legislation.
13. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Any dispute will be subject to the jurisdiction of the applicable South African courts, subject to any consumer rights or dispute-resolution mechanisms available under applicable law.
14. Severability
If any provision of these Terms and Conditions is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where legally possible.
The remaining provisions will continue to apply.
